National Labor Relations Board Moves Forward with a Number of Harmful Rulings

In December, the NLRB approved a set of proposed new regulations concerning union representation votes, commonly known as the "ambush election" rule. "Ambush' elections allow labor unions to silence opponents and take advantage of those unfamiliar with the union election process. "We are disappointed, yet not surprised, that the NLRB would endorse such a practice," said IFA President & CEO Steve Caldeira in a statement released on Dec. 12.

Continuing with their effort to push through several pro-labor decisions before 2015 when Democrats lose their Senate majority, the Senate voted 54-40 along party lines to confirm the nomination of Lauren McFerran to the NLRB. McFerran was formerly the chief labor counsel of the Senate Committee on Health, Education, Labor and Pensions Committee. Additionally, the NLRB also decided in favor of Purple Communications, siding with employees' communication rights over employer property rights, effectively allowing employees to use their employer-provided email system for non-work-related messages and during non-working times.

Finally,the Browning-Ferris Industries case, which could potentially create a new, broader, standard for joint employment, follows NLRB General Counsel Richard Griffin's recommendation that franchisors be considered joint employers with franchisees. IFA has been at the forefront of efforts to preserve the current joint employer standard, which is the basis of the franchise model and supported by nearly 40 years of established law.
